BackgroundBACKGROUND The Surgeon General of the United States has concluded that there is no risk-free level of exposure to secondhand tobacco smoke. The United States Environmental Protection Agency (EPA) has found secondhand tobacco smoke to be a risk to public health and has classified secondhand smoke as a group A carcinogen, the most dangerous class of carcinogen. Furthermore, the California Air Resources Board has categorized secondhand smoke as a toxic air contaminant. Exposure to tobacco smoke is hazardous to smokers and non-smokers alike. LEGAL STATUTES Existing law AB 846 Government Code Section 7597 prohibits smoking within 20 feet of a main entrance, exit and operable window of all public buildings (buildings owned and occupied, or leased and occupied by the state, county or city) as well as buildings on the campuses of the University of California (UC), California State University (CSU), and and California Community Colleges, effective January 1, 2004. For the law to be effective, a sign must be posted describing the no smoking prohibition. A violation of these provisions is an infraction. California Government Code Sections 7596(a) of the law defines a public building asa building owned and occupied, or leased and occupied, by the state, a county, a city, a city and county, or a California community college district. The law applies to all state, county and city government buildings. The n law does NOT apply to privately owned buildings, unless they are leased or occupied by a state, county or city agency. California Government Code Section 7597.1 allows for the California State Universities, the University of California and each community college district to have the authority to set enforcement standards for their local campuses. They may impose a fine for the first, second and third offense and each subsequent offense in the amount to be determined by the local governing body. The civil fine shall not exceed one hundred dollars ($100). Existing law establishes the University of California, under the administration of the Regents of the University of California, the California State University, under the administration of the Trustees of the California State University, and the California Community Colleges, under the administration of the Board of Governors of the California Community Colleges, as the public segments of postsecondary education. Existing law prohibits public employees or members of the public from smoking any tobacco product inside a public building or in an outdoor area, as specified. Existing law states that provision does not preempt the authority of the California Community Colleges, the California State University, or the University of California from adopting and enforcing additional smoking and tobacco control regulations and policies. This bill would provide that the governing bodies of the California State University and each community college district have the authority to enforce these requirements by citation and fine, as specified. The bill would provide that if a campus adopts the enforcement and fine authority, it may post signs stating its tobacco use policy and inform employees and students of the policy, as specified. This bill would authorize the Regents of the University of California to adopt the above provisions. The people of the State of California do enact as follows: SECTION 1. Section 7597.1 is added to the Government Code, to read: 7597.1. (a) The governing bodies of the California State University, the University of California, and each community college district have the authority to: (1) Set enforcement standards for their local campuses. (2) Impose a fine for a first, second, and third offense and for each subsequent offense. The amount of fines is to be determined by the local governing body. Funds shall be allocated to include, but not be limited to, the designated enforcement agency, education and promotion of the policy, 92Ch. 617 2 and tobacco cessation treatment options. The civil penalty shall not exceed one hundred dollars ($100). III. ProvisionsPROVISIONS Each college will identify designated smoking areas. It will ensure that clear and consistent signage are displayed at all at all entrances to the campus, as well as other conspicuous locations, to notify the public that smoking is permitted only in the officially designated areas and is otherwise prohibited on the campus grounds or in campus buildings. The smoking prohibition applies to District owned vehicles and all other District owned mobile equipment. Off site facilities are responsible for defining appropriate smoking policies in accordance with their local municipal ordinances. No tobacco related advertising or marketing shall be permitted at FH/DA or in publications produced by FH/DA. 5.0 The use of tobacco products includes but is not limited to cigarettes, cigars, cloves, bidis, pipes, hookah, marijuana and electronic cigarettes. No funding shall be solicited, nor accepted from any tobacco manufacturing company for any department, program or function of FH/DA. Such funding includes, but is not limited to academic and athletic scholarships, sponsorships, gifts and capitol improvement funds. The sale of tobacco products on campus is prohibited. Each college has the responsibility of communicating the Non-Smoking Policy to students and staff of the District. This policy shall be communicated to all students and employees annually and published in the colleges' Schedule of Classes, handbooks, Web sites, and other appropriate locations. FH/DA may provide interested students, visitors, and staff with information on, or refer them to smoking cessation services. IV. Enforcement ProvisionsENFORCEMENT 1.0 The success of this policy relies on the compliance of all students, employees and visitors. 2.0 Violations of this policy by students may be referred to the Dean of Student Affairs and Activities or Dean of Student Development of the appropriate college to enforce compliance consistent with the Student Code of Conduct. Similar situations involving employees may be referred to District Human Resources. Violations of the Districts No-Smoking Policy shall be enforced by the District Police Department. A citation will be issued to each violator indicating the persons identifying information, date and time of the violation, the location of the offense and the legal statues authorizing the issuance of the citation. The fine for the first violation shall be $25, $50 for a second violation and $75 for third and subsequent violations. The District Police Department will maintain a database of citations issued to assist in determining the correct fine amount. When a subject is issued a third citation, the students information will be forwarded to the appropriate colleges Dean of Student Affairs or District Human Resources in the case of an employee. A fourth or subsequent violation may result in student judicial proceedings or personnel action as permitted by labor agreements. 3.0 An appeal process shall be created to ensure the due process of any person cited in accordance with District Policy. For students, the first level appeal will be in writing to the appropriate colleges Dean of Students (or their designee) and the second level appeal will be an in-person hearing with the Dean of Students (or their designee). The third and final level of appeal will be an in-person hearing with the College President (or their designee). The findings of these individuals will be final and binding. Failure to pay a fine may result in a hold on college records as provided for by existing policy. For employees, the first level appeal will be in writing to the Director of District Human Resources and the second level appeal will be an in-person hearing with the Director of Human Resources. The third level appeal will be an in-person hearing with the Vice Chancellor of Human Resources. The findings of the Vice Chancellor of Human Resources will be final and binding. 4.0 Fines will be collected by the District Police Department and deposited into a special object code account. Those monies collected will be divided as follows; seventy percent (70%) will be retained by the District Police Department for enforcement activities (including but not limited to; personnel to manage the no-smoking citation program, supplies and staffing for enforcement activities). Thirty percent (30%), divided equally between both campuses, will be transferred to the Health Services object code account for smoking cessation treatment options.
